01Scope
This policy applies to personal information we process through the Service. It does not apply to information you share directly with other users, such as text messages between a buyer and a seller, or to third-party websites and services we link to. Those are governed by the other party’s practices.
02Information we collect
Information you give us when you list a vehicle:
- Contact details: your name, mobile phone number, ZIP code, and email address if you provide one.
- Vehicle identifiers: VIN, and license plate number and state if you choose to look up your vehicle by plate.
- Vehicle details: year, make, model, trim, color, mileage, condition answers, accident history, number of keys, price, and description.
- Photos you upload. Photos may contain embedded metadata, such as the date taken or device information, and may show people, addresses, or other license plates if you include them.
- Consent records: whether you agreed to receive text messages and confirmed your listing is accurate, including the exact consent language shown and the date and time.
Information collected automatically:
- Usage and device data, such as pages viewed, referring page, approximate location derived from IP address, browser type, device type, and operating system, collected through privacy-focused analytics that does not use advertising cookies.
- Search terms you enter on the Service, which we use to improve search results and understand demand.
- Server logs, including IP address and timestamps, used for security and debugging.
- Local storage on your device that remembers preferences, such as whether you have already seen our welcome introduction. This data stays on your device.
Information from third parties: when you enter a VIN or license plate, we receive vehicle specifications, such as make, model, trim, and drivetrain, from our vehicle data provider.
03Information that is public
When you publish a listing, the following information is visible to anyone, may be indexed by search engines, and may be copied by others: your first name, your ZIP code, your phone number (which is embedded in the "Text the seller" button), your vehicle photos and details, your description, your price, and the last six characters of your VIN.
Your last name, email address, full VIN, and license plate number are not displayed on your listing. Once information has been made public, we cannot control how others use it, and removing your listing will not remove copies others may have made or results cached by search engines.
04How we use information
- To create, display, and manage your listing and let buyers contact you.
- To decode your vehicle and pre-fill specifications, estimates, and suggested pricing.
- To draft a listing description using AI, which you review before publishing.
- To send text messages you have consented to receive, and to honor opt-out requests.
- To operate, maintain, secure, and improve the Service, including search and fraud prevention.
- To detect, investigate, and prevent fraud, abuse, and violations of our Terms.
- To comply with legal obligations and enforce our rights.
05Artificial intelligence
To draft your listing description, we send vehicle details and your condition answers to an AI model provider. We do not send your name, phone number, or email address for this purpose. Our provider processes this data on our behalf under contractual terms and, under its API terms, does not use it to train its models by default.
We do not use your personal information to train large language models or other AI models.
06License plate and VIN lookups
Plate and VIN lookups return vehicle information only, such as year, make, model, and trim. We do not request or receive registered owner names, addresses, or other personal information from motor vehicle records. We do not offer lookups of other people’s vehicles as a service.
08Categories of personal information
The table below summarizes the categories of personal information we have collected in the past 12 months, as described in the California Consumer Privacy Act and similar laws.

We do not collect sensitive personal information as defined by state law, such as government ID numbers, precise geolocation, or financial account numbers.
09Retention
We keep listing information while your listing is active and for a reasonable period afterward to handle questions, prevent fraud, and keep records. When it is no longer needed, we delete or de-identify it. We keep consent and opt-out records for as long as needed to demonstrate compliance with messaging laws. Server logs and analytics are kept for a limited period. Backups may persist for a short time after deletion.
10Security
We use reasonable administrative, technical, and physical safeguards, such as encryption in transit, access controls, and private file storage, to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Keep your listing management link private, because anyone who has it may be able to change your listing.
11Your choices and rights
Depending on where you live, including California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, Virginia, and other states with similar laws, you may have the right to:
- know and access the personal information we hold about you, and receive a portable copy;
- correct inaccurate personal information;
- delete personal information we collected from you;
- opt out of the sale of personal information, targeted advertising, and certain profiling (we do not engage in these); and
- appeal our decision on your request.
To make a request, email privacy@evcars.com or text +1 (385) 438-6678. We will verify your request, typically by confirming control of the phone number on your listing, and respond within the time required by law. You may use an authorized agent, and we may ask for proof of the agent’s authority. If we deny your request, you may appeal by replying to our decision with "Appeal" in the subject line. If you are not satisfied with the result of your appeal, you may contact your state attorney general.
We will not discriminate against you for exercising your privacy rights. We honor Global Privacy Control signals as a request to opt out of sale and sharing, although we do not sell or share personal information.
Text messages: reply STOP to any message from us to opt out, or HELP for help.
12Children
The Service is not directed to anyone under 18. We do not knowingly collect personal information from children under 13, or from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.
13Location of processing
The Service is intended for users in the United States, and we process information in the United States. If you access the Service from elsewhere, you understand your information will be transferred to and processed in the United States.
14Changes to this policy
We may update this policy from time to time. We will post the updated policy with a new effective date and, for material changes, provide notice through the Service or by text message if you have opted in.
